We respect you and your privacy.  Folk Rebellion has to collect some personal information in order to fulfill your order, but we will never sell, rent or trade that information with any third party.  You will only receive promotional e-mails if you subscribe, and you can opt out at any time.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.


When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.


Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

 

SECTION 2 - CONSENT

How do you get my consent?


When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.


If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

 

How do I withdraw my consent?


If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at hello@folkrebellion.com.

 

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

SECTION 4 - SQUARESPACE

Our store is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and services to you.


Your data is stored through Squarespace’s data storage, databases and the general Squarespace application. They store your data on a secure server behind a firewall.

 

Payment:
If you choose a direct payment gateway to complete your purchase, then Squarespace stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.


All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. 
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.


However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.


For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.


In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.


As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.


Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.


If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.


SECTION 7 - AGE OF CONSENT

 

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

SECTION 8 - CHANGES TO THIS PRIVACY POLICY

 

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.


If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

SECTION 9 - COOKIES

As you browse Folk Rebellion and other websites, online ad networks we work with may place anonymous cookies on your computer, and use similar technologies, in order to understand your interests based on your (anonymous) online activities, and thus to tailor more relevant ads to you.   If you do not wish to receive such tailored advertising, you can visit this page to opt out of most companies that engage in such advertising.  (This will not prevent you from seeing ads; the ads simply will not be delivered through these targeting methods.)

Retreats

TERMS & CONDITIONS / REFUND POLICY

Folk Rebellion events are “boutique” programs with limited capacity. The flip side of that is that while some programs will overbook, at rare times, others may not have sufficient attendance for the facilities and programming. If that occurs, we will let attendees know as soon as possible.

At that point:

We will refund your payment in full.

You will receive %10 off a future event.

Pre-registration is required for the events (adventures, multi-day, single day and retreats). Payment for multi-day events must be made 60 days prior to your retreat. Single day and events pre-payment terms are specific to each event.

REFUND POLICY:

MULTI-DAY: Pre-paid purchases and associated reservations are non-refundable within 30 days of the multi-day event, except in the case the event does not occur. Refunds for full pre-pay registration will be issued at 50% refund of payment until three months prior to the event. Deposits will not be refunded – which stinks so plan to join us! Credit card transaction fees will be deducted from all refunds. Within three months of the multi-day event, no refunds issued. However, if you cannot attend an event you have paid for, you can transfer it to a friend, family member, etc. who can take your spot but can not apply it to another event.

SINGLE DAY EVENTS: Pre-paid purchases and associated reservations are non-refundable within 15 days of single day event, except in the case the event does not occur. Credit card transaction fees will be deducted from all refunds. Within 14 days of the Day, no refunds issued. However, if you cannot attend an event you have paid for, you can transfer it to a friend, family member, etc. who can take your spot but can not apply it to another event.

TRAVEL

Participants will make their own transportation arrangements to the escape unless noted in our itinerary. We cannot issue a refund if you are not able to attend the escape due to weather, cancelled flights or other travel limitations. Folk Rebellion is not liable for any customer travel, food, incidentals or other costs incurred not included in our retreats.

If itinerary details change due to circumstances beyond our control, we will contact you immediately. We will do our best to replace any original elements with a comparable offering. In rare cases, Folk Rebellion is not responsible for events beyond its control such as: weather, acts of God, closure of public transportation/airports/etc., failure of execution by 3rd parties (e.g. supplies, subcontractors).

WAIVER

By REGISTERING for any event, adventure or retreat, you are agreeing to the terms of the waiver below.

ASSUMPTION OF RISK AND LIABILITY WAIVER

I represent that I am in good physical health and capable of participating in the Folk Rebellion event I have chosen to attend. I understand that during my participation in a Folk Rebellion Adventure, Event or Retreat (Event), I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in each Event and cannot be eliminated without destroying the unique character of the Event. These inherent risks include, but are not limited to, the dangers of serious personal injury, property damage, and death (“Injuries and Damages”) from exposure to the hazards of travel and Folk Rebellion has not tried to contradict or minimize my understanding of these risks. I know that Injuries and Damages can occur by natural causes, or activities of other persons, animals, plants, Organizers, Co-Organizers, Event Hosts, Members and assistants or third parties, either as a result of negligence or because of other reasons. I acknowledge that the enjoyment and excitement of the event in which I am registering is derived in part from the inherent risks in outdoor activity and these risks contribute to the enjoyment and are a reason for my participation. I understand that risks of such Injuries and Damages are involved in hiking, SUP, yoga, biking, snowshoeing, skiing and other adventure activities offered within Folk Rebellion Events, Adventures and Retreats and I appreciate that I may have to exercise extra care for my own person and for others around me in the face of such hazards. I further understand that on this Event there may not be rescue or medical facilities, first aid, or the expertise necessary to deal with the Injuries and Damages to which I may be exposed.

In consideration for my acceptance as a participant on these Events, and the services and amenities to be provided by Folk Rebellion in connection with these Events, I confirm my understanding that:
• I have read any rules and conditions applicable to the Event made available to me; I will pay any costs and fees for the Event; and I acknowledge my participation is at the discretion of Folk Rebellion.

• The Event does not include carpooling, transportation, or transit to and from the Event, and I am personally responsible for all risks associated with this travel.

• If I decide to leave early and not to complete the Event as planned, I assume all risks inherent in my decision to leave and waive all liability against Folk Rebellion arising from that decision. Likewise, if a leader has concluded the Event, and I decide to go forward without the leader, I assume all risks inherent in my decision to go forward and waive all liability against Folk Rebellion arising from that decision.

• I understand that Folk Rebellion reserves the right to exclude from the trip any person he judges to be incapable of meeting the rigors of participating in the activities or who refuses or is unwilling to follow the directives of the activity leaders.

This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.

To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE CLAIMS, AND RELEASE FROM LIABILITY Folk Rebellion, it’s owners, teachers, guides, assistants and other leaders from any and all liability on account of, or in any way resulting from Injuries and Damages, even if caused by negligence of Folk Rebellion’s teachers, guides, assistants and other leaders, in any way connected with this Event. I further agree to HOLD HARMLESS Folk Rebellion, it’s teachers, guides, assistants and other leaders from any claims, damages, injuries or losses caused by my own negligence while a participant on the Event. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me on the Event.

Folk Rebellion accepts no liability for loss, damage or illness occurring during the escape.
